General Terms of Sale
Article 1 - Prices 1.1 - The prices of our products are indicated in euros, inclusive of all taxes and including processing and shipping costs.
1.2 - Bloom Bra reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time of your order validation.
1.4 - Products remain the property of Bloom Bra until full payment has been received. We remind you that when you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
1.5 - Bloom Bra does not sell to professionals.
Article 3 - Validation of your order You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. Confirmation of your order therefore implies acceptance of these General Terms and Conditions of Sale.
A summary of your order information and the General Terms and Conditions of Sale will be sent to you in PDF format via the e-mail confirming your order.
Article 4 - Availability Bloom Bra is a retailer and does not sell large quantities of the products offered. Consequently, Bloom Bra reserves the right to refuse orders for the same product in large quantities, from 3 identical items.
Our product offers are valid as long as they are visible on the site, within the limits of available stocks, except for promotional operations mentioned as such on the site. In the event of product unavailability after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made. For your information, the debit will only be made when the parcel is dispatched.
Article 5 - Delivery Delivery charges will be specified on the site, including all taxes, during the ordering process and must be accepted by the customer when the order is validated.
They will appear on a separate line from the product price.
It is expressly specified that the amount of delivery charges may vary according to the territory in which the products are delivered, which the customer expressly acknowledges and accepts.
Delivery times are indicated on the site and depend on the delivery method chosen by the customer. Delivery times exclude Saturdays, Sundays and public holidays.
Delivery times include the preparation and dispatch of the order, as well as the time taken to deliver the products to the point of delivery (the customer's postal address or delivery point).
In the absence of any indication on the site of a delivery time for the products, Bloom Bra undertakes to deliver them within a maximum period of 30 (thirty) days from the order validation email sent to the customer by Bloom Bra. In this case, the products concerned are delivered within the time indicated on the site and recalled at the time of the order.
However, as Bloom Bra uses external service providers (carriers, postal services, etc.) for the delivery of products, Bloom Bra is totally dependent on these third-party service providers. The delivery times indicated on the site may therefore be affected by the service providers, without Bloom Bra being responsible for these delays in delivery and the consequences that may result.
When the delivery is made against a signature, this is proof that the parcel has been received correctly. The transfer of risk and responsibility for the products takes place upon receipt of the products by the customer. From this date, the customer shall be solely and exclusively responsible for them, as well as for their use and any consequences that may arise therefrom. Consequently, the customer undertakes to check, at the time of delivery, that the order delivered is complete, compliant and has not been damaged. If this is not the case, the customer undertakes to refuse to accept the order and to sign any supporting documents. Any order received against the customer's signature will be deemed to be compliant, complete and in perfect condition at the time of delivery.
ARTICLE 6 - Payment The customer pays on the www.bloom-bra.com website by credit card from the Visa, Mastercard, Maestro and American Express networks via the Paypal and Apple Pay secure payment platform.
Payment via Paypal: payment methods are specific to the Paypal payment platform, and are independent of Bloom Bra, which is in no way involved in the use of said service. All terms and conditions relating to payment via the Paypal payment solution are governed by the General Terms and Conditions of Use of this service, accessible at https://www.paypal.com/fr/webapps/mpp/ua/useragreement-full, which apply concurrently with these GTC. Bloom Bra does not store any of the customer's bank details, subject to the provisions below. Bloom Bra cannot be held responsible for any malfunction of the Paypal payment platform.
By accepting these terms and conditions, the customer also agrees to be bound by Paypal's General Terms and Conditions of Use, which are available at the above address. These are subject to change by Paypal only. Under no circumstances may Bloom Bra modify the General Terms of Use of Paypal, a service provider over which it has no control.
ARTICLE 7 - Withdrawal The customer has a period of 14 days from the date of delivery of the order to return any new and unopened product, in its original packaging and in perfect condition (any damaged, incomplete, damaged product or whose packaging has deteriorated will not be accepted), to request reimbursement without penalty.
The customer must place the undamaged packaging containing the product in a suitable package to which the return label will be affixed, before sending it by post. The customer must also enclose a copy of the invoice or any other element that identifies the order and its owner.
The return of the product is at the customer's expense. If the package is lost, stolen or damaged when the product is returned, Bloom Bra reserves the right to refuse reimbursement of the returned product(s).
Only the customer identified as such to Bloom Bra may exercise this right, to the exclusion of any other person, and in particular the recipient of the delivery. The return address is: 89 Rupara Street, Modbury North Dc, Australia.
